Ninth Amendment Problems: Protection of Other Rights Not Enumerated
This Amendment seems to have been wholly destroyed. This author cannot recall a case in fifty years when a "right not delegated belongs to the people".
There is nothing left. At all.
Put cynically, "When the government wants something, it creates a law. Therefore perhaps one defendent escapes free, then by the law created the following month, everyone else no longer has that right". Put even simpler, A right not Enumerated belongs to the People, at which point it becomes Enumerated, and therefore no longer belongs to the People.
